TF, a 15 month old minor, was seated on her mother’s lap in the front passenger seat. They were traveling on a dark, unlit, country Road in eastern Colorado when they came around the corner and encountered a black horse standing in the middle of the Colorado highway. The owner of the horse knew that it had been getting out frequently but took no action to prevent this from happening again.
When the car collided with a horse, TF was thrown forward into the dashboard and windshield. She sustained serious injuries to her face and head, including a traumatic brain injury. She was taken by Flight for Life to Children’s Hospital in Denver where she was treated for number of weeks.
McCormick & Murphy brought a lawsuit against the owner of the horse.
The defendant hired various experts, including accident reconstruction engineers, and asserted that the parents were at fault for not restraining their child in the car seat. They also claimed the father was traveling at higher than the posted 45 mile-per-hour speed limit.
McCormick & Murphy refused to give up. The case settled seven years later for the sum of $390,000. Some of these funds were used to pay back health insurance and attorney fees. The bulk of the funds were placed in a structured settlement for the benefit of the minor.
