The Best Injury Attorneys are Excellent Communicators

The Best Injury Attorneys are Excellent Communicators
While your attorney may not be able to respond to emails and calls 24/7, he or she should be able to respond as quickly as possible and communicate with you during business hours.
Communication with your lawyer should be stress-free. If you ask questions and get vague or incomplete answers, then you might need to find someone who can answer questions thoroughly and give you the information you need.
Personality is also key when it comes to communication. You need to find a lawyer you feel comfortable around. You want someone who will listen to you instead of ignoring you or talking down to you condescendingly. If you are afraid to discuss the details of your case with your lawyer because of trust issues, then you need to find someone you can trust completely. A lack of trust is going to negatively affect your case.

At McCormick & Murphy, our team of experienced Pueblo personal injury lawyers takes a great deal of pride in treating our clients like family and doing everything we can to always keep them updated on the status of their claims.

We understand the full scope of how an injury impacts your life, and we’re committed to pursuing every category of damages you’re entitled to under Colorado law.

Great Personal Injury Lawyers Have Great Client Reviews

When comparing lawyers, you should look to online reviews to help you make up your mind. Look for client testimonials, which are often found on the lawyer’s website. Look for Google reviews as well. Dozens of good reviews are a good sign. Few reviews for any lawyer is not a good sign. If you see a negative review upon a negative review, then it’s best to move on to someone else.

At McCormick & Murphy, we are proud to have earned dozens of positive reviews on Google clients, in addition to receiving hand-written reviews from our past clients.

WHEN SOMEONE SAYS THEY NEED AN ATTORNEY, I TELL THEM TO CALL MY ATTORNEY.

C. O., Pueblo

I am very happy with my attorney, Jay Murphy, and the law firm of McCormick & Murphy, P. C. In 2009, I was injured in an auto collision involving a road rage incident in Pueblo, CO. The other driver denied everything and lied to the insurance company. His insurance company ignored me and would not recognize my claim. I contacted some other attorneys but they would not represent me. About 18 months after the collision, I hired Mr. Murphy. He and his staff were very helpful and responsive to my calls and questions. They assisted me throughout each step of the claim process. They helped me get all of my medical bills and liens paid. They negotiated a very good settlement on my behalf and kept me informed throughout. I felt very comfortable with them. I am satisfied with McCormick & Murphy law firm and give them the highest recommendation. When someone says they need an attorney, I tell them to call my attorney.

THE OTHER DRIVER’S INSURANCE WANTED TO SETTLE FOR JUST $2,600…I ENDED UP RECOVERING $165,000

C. O., Pueblo

In November 2008, while I was driving from one office to another, on Hwy 50 east of Pueblo, I slowed to avoid a vehicle that had stopped after striking a deer. A pickup truck behind me struck the rear of my Jeep, propelling me off the road into a ditch. At first, I didn’t think I was too badly hurt and I declined the ambulance and did not go the emergency room. Soon, however, my back and shoulder were becoming quite painful and I was having difficulty sleeping. I tried to get my employer and the workers comp carrier to allow me to see a doctor, but they dragged their feet. Finally, after about three weeks, I did see a doctor. That doctor, a workers compensation doctor, quickly declared that I was able to return to full work duties and filed a closing report with workers compensation (even though I needed further care). The other driver’s insurance wanted to settle for just $2,600. I decided I needed to see an attorney about my injuries, my insurance, and my unpaid property damage. I searched for a Christian attorney. I found the law firm of McCormick & Murphy and set up an initial free consultation with them. The initial meeting was informative and I did not feel pressured by them. I felt comfortable with the attorney I met with and decided to hire them. They gathered my medical records, guided me with my insurance issues and my need to get treatment (including surgery on my shoulder and treatment of my chronic back pain), and assisted with my worker’s compensation claim and settlement. Then, after trying to settle my injuries with the liability insurance carrier for the pickup truck driver, they filed a lawsuit on my behalf. Ultimately, we were able to settle my claims at a settlement conference with a mediation judge. I ended up recovering $165,000 on my injury claims. I felt the attorney and staff and McCormick & Murphy were quick and responsive in responding to my questions throughout this process.

Your Attorney Needs to Be Qualified and Prepared to Take Your Case to Trial

While most personal injury cases settle outside of court, some do go all the way to the courtroom. Insurance companies are not always willing to settle and will go to great lengths to get you to back down. When they threaten to go to court, you want a lawyer with trial experience. If your lawyer is scared to face defendants and judges in court, this says a lot about his experience as a lawyer.
This will negatively affect the outcome of your case. You will be forced to settle for much less money. Get an aggressive lawyer who will defend you in court if necessary.

Pueblo Personal Attorney Services

An unexpected accident can turn your life upside down. If you’ve been injured in Pueblo, Colorado, due to someone else’s carelessness, you’re likely facing not only physical pain and emotional stress but also mounting medical bills and lost income. The thought of dealing with insurance companies, who often prioritize their profits over your recovery, can feel overwhelming.

You don’t have to face this challenging time alone. At McCormick & Murphy, P.C., our experienced Pueblo personal injury attorneys are here to stand with you. Since our founding in 1995, we have helped individuals like you in Pueblo and across Colorado secure the full financial recovery you need to heal and rebuild your life. Our founders, Kirk R. McCormick and James “Jay” Murphy, bring over 60 years of combined legal experience, including valuable insights from their prior work representing insurance companies.

Why You Need a Pueblo Personal Injury Attorney on Your Side

Insurance companies are powerful organizations with skilled adjusters and attorneys whose primary goal is to pay you as little as possible. When you try to handle a personal injury claim on your own, you’re often at a disadvantage. They may pressure you, delay your claim, or even deny it outright.

Here’s how trying to handle a personal injury claim alone can impact you:

  • You might accept a low offer before understanding the true cost of your injuries.
  • You could miss important deadlines, jeopardizing your ability to claim compensation.
  • You may not know every type of financial recovery you’re entitled to.
  • Dealing with medical providers and insurance paperwork adds stress to your recovery.
  • Innocent statements you make could be used against your case.

Our personal injury attorneys at McCormick & Murphy, P.C., are your shield and your advocate. We protect your rights, handle all communications, and fight tirelessly for the maximum financial recovery you deserve, allowing you to focus completely on your healing.

Common Types of Personal Injury Cases We Handle in Pueblo

Our Pueblo personal injury attorneys are dedicated to helping accident victims across a wide range of incident types. We have a strong track record of success in cases involving:

Motor Vehicle Accidents

Car accidents are a common source of personal injury. Whether you were hit by a distracted driver, drunk driver, or someone who ran a red light, you may be able to secure financial recovery for:

  • Medical expenses (current and future)
  • Lost wages and reduced earning ability
  • Property damage
  • Pain and suffering
  • Emotional distress

Colorado follows a modified comparative negligence rule, meaning you can still recover damages even if you were partially at fault for the accident. However, your compensation will be reduced by your percentage of fault.

Truck Accidents

Commercial truck accidents often result in devastating injuries due to the size and weight of these vehicles. Truck accident cases are more complex than regular car accidents because multiple parties may be responsible:

  • The truck driver
  • The trucking company
  • The cargo loading company
  • Vehicle manufacturers
  • Maintenance companies

Our attorneys know how to investigate truck accidents thoroughly and identify all responsible parties to maximize your recovery.

Motorcycle Accidents

Motorcyclists face unique challenges after accidents. Despite Colorado’s helmet law only applying to riders under 18, insurance companies often try to blame motorcyclists for their injuries. We fight against these unfair biases and work to prove the other driver’s carelessness caused your accident. We have a proven record of success in motorcycle accident cases.

Slip and Fall Accidents

Property owners have a legal duty to maintain safe conditions for visitors. If you were injured due to:

  • Wet or slippery floors
  • Poor lighting
  • Uneven surfaces (e.g., cracked sidewalks in downtown Pueblo)
  • Inadequate security
  • Falling objects

You may have a premises liability claim against the property owner or manager.

Medical Malpractice

When healthcare providers fail to meet the standard of care, patients suffer. Medical malpractice cases require extensive medical knowledge and expert testimony. We work with qualified medical experts to prove:

  • The healthcare provider owed you a duty of care
  • They breached that duty
  • The breach caused your injury
  • You suffered damages as a result

Wrongful Death

Losing a loved one due to someone else’s carelessness is devastating. While no amount of money can bring them back, wrongful death compensation can help families with:

  • Funeral and burial expenses
  • Lost income and benefits
  • Loss of companionship
  • Medical expenses before death

Colorado law allows spouses, children, and parents to file wrongful death claims within two years of the death.

Insurance Bad Faith

Beyond standard personal injury claims, McCormick & Murphy, P.C., also specializes in insurance bad faith cases. If your insurance company has unreasonably delayed, denied, or undervalued a legitimate claim (whether it’s auto, home, health, life, or disability insurance), we can help you fight back. Our founders’ unique experience defending insurers gives us an insider’s view on how to hold them accountable.

How Colorado Personal Injury Laws Affect Your Case

Understanding Colorado’s specific laws is essential for your personal injury claim. Our attorneys ensure your case is handled correctly, protecting your right to recovery.

Statute of Limitations

You have a limited time to file a personal injury lawsuit in Colorado:

  • Most personal injury cases: 3 years from the date of injury
  • Medical malpractice: 2 years from discovery of the injury
  • Wrongful death: 2 years from the date of death
  • Claims against government entities: 182 days to file a notice of claim

Missing these deadlines can bar you from recovering any compensation, regardless of how strong your case is.

Comparative Negligence

Colorado follows a modified comparative negligence rule. This means:

  • You can recover damages even if you were partially at fault
  • Your compensation is reduced by your percentage of fault
  • You cannot recover if you were 50% or more at fault

For example, if you were 20% at fault for an accident and suffered $100,000 in damages, you could recover $80,000. Our attorneys diligently work to minimize any fault attributed to you.

Damage Caps

Colorado has specific limits on certain types of damages, particularly relevant in 2025 due to recent adjustments:

  • Non-economic damages (like pain and suffering) in most personal injury cases can now be as much as $1,500,000 (effective January 1, 2025). This significantly impacts cases with severe injuries.
  • Non-economic damages in medical malpractice cases are capped at approximately $300,000 (adjusted for inflation).
  • Punitive damages are generally limited to the amount of compensatory damages.

These caps don’t apply to most general personal injury cases but are crucial for those with specific claims like medical malpractice.

What Damages Can You Recover in a Personal Injury Case?

When you’ve been injured, compensation isn’t just about covering immediate bills. It’s about securing your future and acknowledging the full impact the accident has had on your life. Depending on the details of your case, you may be able to recover financial losses for:

Economic Damages

These are quantifiable financial losses, supported by bills and records:

Medical Expenses

  • Emergency room visits
  • Hospital stays
  • Surgery costs
  • Prescription medications
  • Physical therapy
  • Future medical care and rehabilitation
  • Medical equipment and assistive devices

Lost Income

  • Wages lost during recovery
  • Reduced earning ability
  • Lost benefits (e.g., retirement contributions, health insurance)
  • Vacation and sick time used

Property Damage

  • Vehicle repairs or replacement (for motor vehicle accidents)
  • Personal property destroyed in the accident

Non-Economic Damages

These compensate for intangible losses, which are subjective but often represent a significant portion of recovery, especially with the new 2025 caps:

Pain and Suffering

  • Physical pain from injuries
  • Emotional distress (anxiety, depression, grief)
  • Loss of enjoyment of life (inability to pursue hobbies, engage in daily activities)
  • Inconvenience and lifestyle changes
  • Disfigurement and scarring

Loss of Consortium

  • Impact on relationships with family members, particularly spouses
  • Loss of companionship, affection, and support

Punitive Damages

In rare cases involving particularly reckless or intentional conduct, Colorado courts may award punitive damages to punish the defendant and deter similar behavior. This is common in cases involving drunk drivers or extreme negligence.

The Personal Injury Claims Process: What to Expect with McCormick & Murphy, P.C.

We understand that the legal process can seem daunting, especially when you’re recovering from injuries. Our goal is to make it as clear and stress-free as possible. Here’s a general outline of what you can expect when working with us:

Initial Investigation

Your attorney will immediately begin investigating your case by:

  • Gathering police reports and incident reports (including those from local Pueblo agencies) and witness statements.
  • Collecting all relevant medical records and bills, often directly from Pueblo hospitals or clinics.
  • Photographing the accident scene and your injuries, preserving crucial evidence.
  • Consulting with accident reconstruction experts or other specialists as needed.
  • Reviewing all applicable insurance policies.

Medical Treatment and Documentation

Getting proper medical care is essential for both your health and your case. Your attorney will:

  • Help you find doctors who will treat you on a lien basis (if needed), especially useful in Pueblo where accessing care might be challenging if you lack insurance.
  • Ensure all your injuries are properly documented.
  • Work with medical experts to establish the full extent and prognosis of your injuries.
  • Calculate current and future medical expenses accurately.

Demand and Negotiation

Once you’ve reached maximum medical improvement, your attorney will:

  • Calculate the full value of your damages, including economic, non-economic (up to $1.5M for 2025 claims), and potential punitive damages.
  • Send a comprehensive demand letter to the insurance company.
  • Negotiate for a fair settlement, leveraging our founders’ experience against insurance defense.
  • Advise you on whether to accept offers or continue negotiations, always prioritizing your best interest.

Filing a Lawsuit (Litigation)

If negotiations don’t result in a fair settlement, your attorney may file a lawsuit. This doesn’t mean you’re going to trial – most cases still settle after filing. The litigation process includes:

  • Discovery: Exchanging information and evidence with the opposing side.
  • Depositions: Taking sworn testimony from witnesses, including you and the at-fault party.
  • Mediation: Structured settlement negotiations facilitated by a neutral third party.
  • Trial: If necessary, presenting your case to a judge or jury in a Pueblo court. McCormick & Murphy, P.C., has extensive trial experience, including successful jury verdicts.

Red Flags: When Insurance Companies Are Taking Advantage of You

Insurance companies are not on your side. Their goal is to protect their bottom line, not your well-being. Be aware of these common tactics they use to minimize what they pay you:

Quick Settlement Offers

If an insurance company offers to settle your case within days of your accident, they’re likely trying to take advantage of you before you know the full extent of your injuries. Many injuries, especially soft tissue injuries or even concussions, don’t show symptoms immediately.

Requesting Recorded Statements

Insurance adjusters often ask for recorded statements under the guise of “routine procedure.” These statements are designed to get you to say something that hurts your case. You’re not required to give a recorded statement to the other party’s insurance company. Let your attorney handle all communications.

Claiming You Don’t Need an Attorney

If an adjuster tells you that you don’t need an attorney or that hiring one will reduce your settlement, they’re not looking out for your best interests. Studies show that people with attorneys recover significantly more compensation than those without representation, even after attorney fees.

Delaying Tactics

Insurance companies sometimes drag out the claims process hoping you’ll get desperate and accept a low offer. They may request the same documents multiple times or claim they need additional information to process your claim, all to wear you down.

Disputing Medical Treatment

If an insurance company questions whether your medical treatment is necessary or related to the accident, they’re trying to reduce their payout. Your doctor determines what treatment you need, not the insurance company.

The True Cost of Personal Injuries: Beyond Medical Bills

The impact of a personal injury extends far beyond just immediate medical bills. Many people underestimate the long-term effects. We work to ensure your compensation accounts for the full scope of your losses, including:

Long-Term Medical Care

Some injuries require ongoing treatment for months or years. This might include:

  • Follow-up surgeries and specialized procedures
  • Physical therapy and occupational therapy
  • Pain management programs and medications
  • Medical equipment and assistive devices
  • Home modifications for disabilities (e.g., ramps, wider doorways)

Lost Earning Ability

If your injuries prevent you from returning to your previous job or working the same hours, you may be entitled to compensation for reduced earning ability. This is especially important for:

  • Manual laborers who suffer back injuries
  • Professionals who suffer brain injuries (like those we discuss as Colorado Springs TBI Lawyers)
  • Anyone whose injuries affect their ability to work at their full capacity

Impact on Daily Life

Serious injuries can affect your ability to:

  • Perform household tasks and maintain your home
  • Participate in hobbies and recreational activities you once enjoyed (e.g., hiking Pueblo Mountain Park trails)
  • Maintain relationships and social connections
  • Care for family members or children
  • Simply enjoy life the way you did before the accident

Emotional and Psychological Effects

Accidents can cause lasting emotional trauma, including:

  • Post-traumatic stress disorder (PTSD)
  • Depression and anxiety
  • Fear of driving or being in vehicles (especially after severe accidents on I-25)
  • Sleep disorders
  • Relationship problems and social isolation

How Modern Technology Strengthens Your Personal Injury Case

At McCormick & Murphy, P.C., we use the latest technology and resources to build the strongest possible case for you. This commitment to innovation helps us achieve better outcomes for our clients:

Artificial Intelligence for Case Analysis

Our team uses advanced AI tools to quickly analyze extensive medical records, identify patterns in similar cases, and accurately value your claim. This means a more precise and effective strategy for your recovery and negotiation.

Digital Evidence Collection

We utilize advanced digital tools for evidence collection, including high-resolution photography, drone footage, security camera retrieval, and vehicle data analysis. This ensures we gather all available information from the accident scene to support your claim.

Medical Documentation

With electronic medical records and advanced imaging, we can clearly demonstrate the full extent of your injuries, their impact on your daily life, and the need for future medical care, strengthening the connection between the accident and your injuries for insurers and juries.

Accident Reconstruction

We work with experts who use computer simulations to recreate accidents. This powerful visual evidence helps demonstrate how the accident occurred, who was at fault, and the forces involved, providing strong support for your case in court or negotiation.

Common Mistakes That Hurt Personal Injury Cases

Protecting your personal injury claim means avoiding certain common missteps. Here are important actions to avoid that could reduce your financial recovery:

Delaying Medical Treatment

Waiting to see a doctor after an accident gives insurance companies ammunition to argue that your injuries aren’t serious or weren’t caused by the accident. Seek medical attention immediately, even if you feel fine.

Not Following Medical Advice

If you miss appointments, stop treatment early, or don’t follow your doctor’s recommendations, insurance companies will argue that your injuries aren’t as serious as you claim.

Talking to Insurance Companies Without an Attorney

Anything you say to an insurance adjuster can be used against you. Let your attorney from McCormick & Murphy, P.C., handle all communications with insurance companies.

Posting on Social Media

Insurance companies monitor social media accounts looking for evidence that contradicts your injury claims. A photo of you smiling at a family gathering could be used to argue that you’re not really suffering. Avoid discussing your case or injuries online.

Accepting the First Settlement Offer

Insurance companies almost always start with lowball offers. Don’t accept any settlement without having an attorney review it first. It is almost always far less than your case’s true worth.

Waiting Too Long to Hire an Attorney

The sooner you hire an attorney, the better they can protect your rights and preserve evidence. Don’t wait until you’re frustrated with the insurance company to seek legal help.

Questions to Ask When Choosing a Personal Injury Attorney

Choosing the right personal injury attorney is an important decision that can significantly impact your recovery. To ensure you find the best fit for your case, consider asking these important questions:

Experience and Track Record

  • How many personal injury cases have you handled, particularly in Pueblo?
  • What types of cases do you handle most often (e.g., car accidents, truck accidents, dog bites)?
  • What is your success rate in settling cases? Can you share recent results for clients with similar injuries?
  • How many cases have you taken to trial? What is your track record in jury verdicts?
  • What results have you achieved for clients with similar injuries? (e.g., For McCormick & Murphy, P.C., mention the Pueblo motorcycle accident $300k settlement, or other multi-million dollar recoveries).

Resources and Support

  • Do you have the resources to fully investigate my case, including hiring experts?
  • Will you hire expert witnesses if needed (e.g., accident reconstructionists, medical specialists)?
  • How many attorneys and staff will work on my case? Will I have direct access to my attorney?
  • Do you work with medical providers in Pueblo who will treat me on a lien basis?

Communication and Availability

  • How often will you update me on my case? What is your communication policy?
  • Will I be able to reach you when I have questions, including after hours for emergencies?
  • Who else in your office can answer questions about my case if my attorney is unavailable?
  • Do you return phone calls and emails promptly?

Fee Structure

  • Do you work on a contingency fee basis?
  • What percentage do you charge? Is it clearly outlined in the agreement?
  • What expenses will I be responsible for, and when are they paid?
  • Do I pay anything if you don’t win my case?

Case Strategy

  • What is your initial assessment of my case’s strengths and weaknesses?
  • What challenges do you foresee in my specific case?
  • How long do you expect my case to take to resolve?
  • What is the likely range of compensation I might expect to recover?

The Importance of Acting Quickly After an Accident

Time is a critical factor in personal injury cases. Acting swiftly after an accident significantly improves your chances of a successful outcome and protecting your rights.

Evidence Preservation

Important evidence can disappear quickly:

  • Accident scenes are cleaned up or altered (e.g., debris removed from a Pueblo street).
  • Security camera footage is deleted or recorded over.
  • Witnesses forget details or move away.
  • Vehicle damage is repaired.
  • Physical evidence is lost or destroyed.

Medical Documentation

Getting prompt medical attention:

  • Creates a clear link between the accident and your injuries in your medical record.
  • Prevents insurance companies from arguing that your injuries were pre-existing or not caused by the accident.
  • Ensures proper treatment that can improve your recovery.
  • Provides comprehensive documentation of your pain and suffering.

Witness Statements

Witness memories fade over time. Getting statements soon after the accident ensures:

  • More accurate recollection of events.
  • Better details about what happened.
  • Contact information before witnesses move or change jobs.
  • Stronger evidence to support your case.

Insurance Company Tactics

Insurance companies start investigating immediately. Having an attorney early helps:

  • Prevent you from making statements that hurt your case.
  • Ensure proper evidence collection.
  • Level the playing field from the beginning.
  • Protect your rights throughout the process.

What Sets Exceptional Personal Injury Attorneys Apart: McCormick & Murphy, P.C.

While many attorneys handle personal injury cases, truly exceptional ones possess qualities that consistently lead to better results and a more positive experience for their clients. McCormick & Murphy, P.C., embodies these qualities:

Trial Experience

While most cases settle, insurance companies pay more to attorneys who are willing and able to take cases to trial. Our founders, Kirk R. McCormick and James “Jay” Murphy, have collectively tried hundreds of personal injury and insurance bad faith cases to verdict in state and federal courts. Look for attorneys who:

  • Have extensive trial experience, not just negotiation experience.
  • Are comfortable and effective in the courtroom.
  • Have a track record of winning significant jury verdicts (e.g., multi-million dollar recoveries).
  • Are respected by judges and opposing counsel in Pueblo and across Colorado.

Resources and Investigation

Strong cases require thorough investigation. Top attorneys:

  • Have relationships with expert witnesses, including accident reconstructionists, medical specialists, and vocational experts.
  • Use advanced technology to build cases, including AI for data analysis.
  • Hire accident reconstruction specialists when needed to prove fault.
  • Work with medical experts to fully understand and prove injuries and future needs.

Client Communication

Excellent attorneys keep clients informed by:

  • Explaining the legal process in plain English, avoiding jargon.
  • Returning calls and emails promptly.
  • Providing regular case updates, so you’re never left wondering.
  • Being available to answer questions and address concerns, providing direct contact info for your legal team.

Negotiation Skills

Skilled negotiators achieve better settlements by:

  • Thoroughly preparing cases before negotiations, demonstrating readiness for trial.
  • Understanding insurance company tactics from an “insider’s” perspective.
  • Knowing when to push for more and when to accept offers.
  • Building professional relationships with insurance adjusters and defense attorneys.

Compassion and Understanding

Personal injury cases are about more than money. The best attorneys:

  • Understand the profound physical, emotional, and financial impact of injuries.
  • Treat clients with respect, dignity, and empathy.
  • Fight passionately for their clients’ rights and their future.
  • Care deeply about their clients’ recovery and overall well-being. Our firm focuses on your healing while we handle the legal fight.

Frequently Asked Questions About Personal Injury Cases

McCormick & Murphy, P.C., works on a contingency fee basis, meaning you don’t pay attorney fees unless we win your case. When we do win, our fee is a percentage of your settlement or verdict (typically 33-40%). You should never have to pay upfront fees for a personal injury case. We also advance all litigation expenses.

How long will my case take?

Case timelines vary depending on several factors:

  • The severity of your injuries and length of medical treatment.
  • Whether the other party accepts responsibility.
  • The complexity of the case (e.g., multiple liable parties).
  • Whether a lawsuit needs to be filed.

Simple cases with minor injuries might settle in a few months, while complex cases with serious injuries could take a year or more, especially if litigation is involved.

Should I accept the insurance company’s settlement offer?

You should never accept a settlement offer without having an attorney review it first. Insurance companies typically start with lowball offers hoping you’ll accept quickly. An experienced attorney can tell you whether an offer is fair and help you negotiate for more, particularly given the new $1.5 million non-economic damage cap in Colorado for 2025.

What if I was partially at fault for the accident?

Colorado’s modified comparative negligence law allows you to recover damages even if you were partially at fault, as long as you were less than 50% responsible. Your compensation will be reduced by your percentage of fault, but you can still recover significant damages. Our goal is to minimize any assigned fault to you.

Do I have to go to court?

Most personal injury cases settle without going to trial. However, having an attorney who is prepared to go to court often leads to better settlement offers. Insurance companies know they’ll have to pay more if they lose at trial, so they’re more likely to offer fair settlements to attorneys with strong trial records like ours.

What if the other driver doesn’t have insurance?

If the at-fault driver is uninsured, you may still have options:

  • Your own uninsured motorist (UM) coverage on your auto insurance policy.
  • Claims against other potentially liable parties (e.g., property owner, employer).
  • Personal assets of the uninsured driver (though often limited).
  • Hit-and-run coverage if the driver fled the scene.

How much is my case worth?

Case values depend on many factors including:

  • The severity and permanence of your injuries.
  • Your medical expenses (past and future).
  • Lost wages and future earning ability.
  • Pain and suffering, emotional distress, and loss of enjoyment of life (now up to $1.5M for non-economic damages in 2025).
  • The strength of the evidence and clarity of fault.
  • The defendant’s available insurance coverage.

An experienced attorney at McCormick & Murphy, P.C., can give you a better estimate after reviewing the specific facts of your case.
